Contract creation and electronic contracting
The technical steps required to create the contract between you and us are as follows:
You place the order for your products on the web-site by pressing the confirm order button at the end of the check-out process. You will be guided through the process of placing an order by a series of simple instructions on the web-site. We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from Paradiddles. As your product is shipped from our warehouse we will send you a despatch confirmation email.
Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions in How to cancel your order.
Non-acceptance of an order may be a result of one of the following:
The product you ordered being unavailable from stock.
Our inability to obtain authorisation for your payment.
The identification of a pricing or product description error.
You not meeting the eligibility to order criteria set out in the main Terms & Conditions.
The contract will be concluded in English.

Contract cancellation
Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right no longer than eight working days after the day on which you receive the Products.
If you wish to exercise your right to cancel this contract prior to order despatch, click on the link and follow the procedure set out in the How do I change or cancel an order section. If your order has already been despatched please follow the procedure set out in our Returns policy.
Please note that your right to return Products does NOT apply to Products which fall into the following categories:
Goods made to your specification (for example gift wrapping) Perishable goods
CD, DVD, tapes or other recording media, software or videos if their seal is broken.
Description of products
Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.
We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy.
Payment
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the Products ordered plus delivery. Payment can be made by any of the methods specified in the Payment section of this Website and payment will be debited and cleared from your account as set out in the Payment section of this Website.
You confirm that the credit, debit or store card that is being used is yours.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
All card payments, are processed for you by Paypal. The total amount you pay is the same regardless of the payment method.
Refusal of transaction
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Look for visible signs of the breakdown and consult the fault finding guide in the manufacturer's handbook, if any
If the product still fails to function, telephone 01494 539950 within 14 days to report the breakdown and to receive authorisation and service details.
Insurance cover (optional)
We will take part of the payment that you make to us and use it to purchase Accidental Damage insurance.
Cover will apply from receipt of your payment throughout your guarantee period and will continue until expiry Cover is limited to the replacement cost of a new product of identical model and type. Should the identical product not be available, the replacement cost of an alternative product of similar specification and quality will be provided, up to the maximum value of the original purchase price.

2. Repair costs for:
work covered by a manufacturer's recall of the product;
consumer replaceable items including, but not limited to fuses, batteries, light bulbs and disposable bags;
breakdown caused by use other than domestic by you or your resident family; cosmetic items such as cabinet trim, scratches, dents, corrosion or colour where the functions of the product are unaffected;
servicing, inspection or cleaning of the insured product;
repairing or replacing of any computer software or virus prevention/detections or external accessories; and
failure to follow the manufacturer's and/or installation guidelines.
3. Any consequential loss suffered as a result of not being able to use the product, or any loss other than the repair and/or the replacement cost of the product.
4. Call out charges where no fault has been found with the product.
Claiming for accidental damage
1. Telephone to arrange for an authorised repairer to inspect the covered product. You will be asked for:
contract number;
your name and address;
date when the accident occurred; and details of the accident;
make and model of your product.
2. The repairer MUST telephone to obtain authority for either the repair cost or replacement product.
Limitations
1. The optional insurance will be provided for products bought and used in the UK, the Isle of Man and the Channel Islands.
2. This agreement shall be governed by and construed in all respects in accordance with the laws of England and each party hereby submits to the non-exclusive jurisdiction of the English Courts.
3. You cannot transfer the insurance to someone else without our prior permission.
4. If a payment or replacement is made because the product is considered uneconomical or not possible to repair then:
the cover ceases and no refund of premium is due;
we may take possession of the product and dispose of it.

Accidental Damage - what is covered? (subject to the following terms and conditions)
1. Repair costs if your product breaks down as a result of an accident. Cover will apply from receipt of your payment throughout your guarantee period and will continue until expiry of your service plan. Cover is limited to the replacement cost of a new product of identical model and type. Should the identical product not be available, the replacement cost of an alternative product of similar specification and quality will be used.

2. Repair costs for:
a) Work covered by a manufacturer recall of the product;
b) Consumer replaceable items including, but not limited to, batteries, light bulbs and other

Our Insurance company and Paradiddles undertake to comply with the Association of British Insurers' Code of Practice for the selling of General Insurance and are designated as company agents, for which the companies they represent accept responsibility. A copy of the code is available from them upon request.
Notice to customers
Any details you supply will be held by Our Insurenace company and their Administrators who will have access to these details only for the purposes of administering your service plan. These details will not be kept for longer than necessary. You are entitled to a copy of this information.
You are advised that any telephone calls made to Our Insurance company Administration and Claims Handling Units are recorded. These recordings may be used to monitor the accuracy of information provided by customers and our own staff, and may also be used to allow additional training to be provided to our staff or to prove that our procedures comply with legal requirements. Staff are aware that conversations may be monitored and recorded. From time to time they may contact you to ask if you have been satisfied with the service. You will be under no obligation to answer these questions but they will be grateful for your co-operation which will help them improve standards.

Survival

We hope you will be highly satisfied with any product purchased on our website but if you wish to return an item to us then we aim to make it as quick and convenient as possible. Any item may be returned for any reason within 28 days of the date of despatch so long as it remains in a saleable condition. We will refund the price of the item and delivery to the purchaser.
Please note that, with the exception of faulty merchandise, we cannot exchange or accept the return of certain items which have been opened and used for example: goods made to your specification, CD, DVD, tapes or other recording media, software or videos if their seal is broken and perishable goods. This does not affect your statutory rights.
When your order is despatched, you will receive a shipping confirmation e-mail.
There are 3 options for exchanging or returning an item:
Return using a courier
If you would like to request a return please email us. We will respond as soon as we can.
The form requires you to fill in your original order number, stock number, the reason for the return, and whether you want a refund or a replacement.
We will e-mail you back with a RETURNS MERCHANDISE AUTHORISATION (RMA) number. Please write this number in the space provided on the reverse of the despatch note.
You will also be given the telephone number for our courier company so that you can arrange a mutually convenient time for collection.

We will ask whether you want a refund or an exchange, and the reason for the return. They will give you a RETURNS MERCHANDISE AUTHORISATION number (RMA number). Please write this number in the space provided on the reverse of the despatch note.
You will also be given the telephone number for our courier company so that you can arrange a mutually convenient time for collection.
Checklist (please ensure you follow all the points below to minimise any delay in dealing with your exchanged or returned item(s).
Write the RMA number in the space provided and write the quantity of the items you are returning in the appropriate column on the despatch note. Please wrap the item securely for transit, using the manufacturer`s original packaging if available, and remember to enclose your despatch note.Once we have received and verified the returned item we will initiate the refund, replacement or exchange.
Order acceptance and the completion of the contract between you and us will take place on the despatch of the Products ordered to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions in How to cancel your order.Non-acceptance of an order may be a result of one of the following:

How do I change or cancel an order?
If you wish to change or cancel an order please contact our customer services team on 01494 539950 any time between 9am and 5pm. It would be helpful if you could have the following details to hand:

Order number
Date of the order
Orders are normally processed immediately so we may have already packaged your order and made arrangements for it to be sent to you. If this is the case then we cannot always stop the order from being sent. Once you receive the order, you will have to return it to us within 28 days of delivery (see our Returns section for further details on our returns policy).
If you wish to cancel the order after delivery, we will refund the cost of the item plus the cost of delivery.
